I would expect every professional DJ to have something similar for you to review prior to making any payments or signing a contract.

This agreement, made between TJ the DJ (hereafter known as “Disc Jockey, DJ or Company”) and ________________________ (here-in-after known as “Client”) is for the purpose of contracting the Disc Jockey Company’s Entertainment Service.

1. The Disc Jockey agrees to provide its mobile Disc Jockey Services on the date, at the location and at the time shown on this contract. Details of the contract are explicitly described and written to provide the client and the DJ with the required information that was mutually agreed upon, to help make the function a successful event.

2. It is understood that if the performance of the DJ is to be located in the outdoors (a “Rain or Shine” event), DJ compensation is in no way affected by inclement weather. For outdoor performances, Client shall provide overhead shelter for setup area. (See #4 below) In the event that Client does not/cannot provide such shelter, and such is deemed necessary by DJ, DJ may provide said coverage at owner’s expense, if any is incurred. The DJ reserves the right, in good faith, to stop or cancel the performance should the weather pose a potential danger to themselves, the equipment used, or the audience/attendees present at the event. In such a case, every effort will be made to continue the performance. However, safety is paramount in all decisions. The DJ’s compensation will not be affected by such cancellation.

3. In the event of circumstances deemed to present a threat or implied threat of injury or harm to DJ staff or any equipment in the DJ’s possession, DJ reserves the right to cease performance. If the Client is able to resolve the threatening situation within a reasonable amount of time (maximum of 15 minutes), DJ shall resume performance in accordance with the original terms and conditions of this agreement. Client shall be responsible for payment in full, regardless of whether the situation is resolved, or whether DJ resumes performance. In order to prevent equipment damage or liability arising from accidental injury to any individual attending his performance, DJ reserves the right to deny any individual other than them selves’ access to the sound system, music recordings, or any other equipment in his possession.

4. Client shall provide DJ with safe and appropriate working conditions. This includes, but is not limited to, a 8-foot by 8-foot area for setup, space for setting up speakers and/or lighting stands, and adequate space for any other equipment that is necessary for the successful performance of the services being provided. DJ requires a MINIMUM of one 15-20 amp circuit outlet from a reliable power source within 10 meters (along the wall) of the setup area. This circuit must be free of all other connected loads. Any delay in the performance or damage to the DJ’s equipment due to improper power is the responsibility of the Client. Two circuits are preferred, where possible. Additional outlets on separate circuits for lighting (if contracted for) are required. Client shall provide crowd control if warranted; and furnish directions to place of engagement. Client is responsible for paying any charges imposed by the venue. These charges may include, but are not limited to, parking, use of electric power, and Fire Marshall if necessary.

5. Client certifies that all applicable entertainment permits for the event are up-to-date, and agrees to show copies thereof to DJ upon demand. DJ agrees to show proof of Insurance, Business license and Music License upon request prior to the event these documents will not be carried on site as a loss prevention measure.

6. This agreement guarantees that DJ will be ready to perform at the start time of the engagement, provided that all responsibilities of the Client outlined herein have been fulfilled. No guarantee is made as to DJ’s time of arrival; however, DJ requires that they be permitted a minimum of 2 hours before and after for set up and take down. DJ service also requests ramp or elevator access between the parking/service entrance and the setup area. If the event requires setup or tear down in less time than specified, or if equipment must be carried upstairs to reach the setup area, additional labour will be charged at a flat rate of $50. If Client or event requires DJ to postpone takedown time more than 30 minutes after the end time indicated, the additional time will be charged at the rate of $50 per half-hour. DJ will not leave equipment and/or program materials unattended, and must be granted full and unrestricted access to the same before, during, and after the event. If the nature of the event itself, the policies/procedures of the venue or any other circumstances require that program materials and/or equipment be left unattended for any amount of time, DJ must be notified prior to access being restricted. Failure to provide said notice could result in placing the safety of the program materials and/or equipment, as well as the safety of individuals at risk.

7. “Additional performance time,” as used herein, is defined as actual DJ performance time beyond and in addition to the specified amount of performance time agreed upon in this agreement, whether before or after the start or end times noted herein. Additional performance time will be billed at $120 per hour one hour after the scheduled end time of this agreement. No guarantee is made as to the ability of the DJ to provide Additional Performance Time, but every reasonable effort will be made by DJ to accommodate the need and/or request for such. The DJ’s compensation will not be affected by the inability to provide Additional Performance Time, regardless of reason.

8. (a)No performance by the DJ shall be recorded, reproduced, or transmitted from the place of performance, in any manner, or by any means whatsoever, in the absence of a specific written agreement with DJ relating to and permitting such recording, reproduction, or transmission. Pictures and videotape of the event are permitted for the private use of the contracting party only.
(b) Unless specifically stated by signing this agreement you give permission for TJ the DJ or an agent of the DJ to take photos and/or recordings of the event though out its duration for potential promotional and advertising use.

9. Additional miscellaneous charges and/or fees that may be incurred above and beyond the Performance Fee, according to the Terms and Conditions contained herein, including but not limited to Additional Performance Time, will be considered PAYABLE IN FULL at the end of the event. THERE ARE NO EXCEPTIONS unless other arrangements are indicated on this contract and are agreed to and initialled by both parties.

10. Events requiring travel outside of our primary service area will be charged at $1.00 per Kilometre in excess of 30 Kilometres. Engagements in excess of 200 Kilometres will require accommodations be made for an overnight stay in a local hotel/motel for DJ at Client’s expense.

11. By executing this contract as Client, the person executing said contract, either individually, or as an agent or representative, represents and warrants that he/she is eighteen (18) years of age, and further, if executing said contract as agent or representative, that he/she has the authority to enter into this agreement and should he/she not have such authority, he/she personally accepts and assumes full responsibility and liability under the terms of this contract.

12. This Agreement cannot be cancelled except by Military Deployment or Death of an Immediate Family Member. Any payments made prior to cancelation may be used towards a future date provided it has not already been booked and with in 1 year of cancelation. Proof of Military deployment or Death of an immediate family member is required to reserve payments for a future date. In all other cases payment in full will be required with in 10 business days for any other reasons for cancelation. Change of date or venue will be accommodated where possible and change in travel charges may apply.

13. In the event that DJ cancels the engagement, all reasonable efforts will be made by DJ to find replacement entertainment services for the agreed upon fees. Should DJ be unable to procure such replacement, Client shall receive a full refund of all payments previously received.

14. Client agrees that in all circumstances, DJ liability shall be exclusively limited to an amount equal to the amount of the Performance Fee, and that TJ the DJ shall not be liable for indirect or consequential damages arising from breach of contract.

15. In the event of non-payment, DJ retains the right to attempt collection through the courts. Client will be held responsible for all court fees, legal fees, and collection costs incurred by DJ. Client shall be charged $50 for each bounced check plus a $10 service charge for each collection notice.

16. All attached riders are an integral part of this contract. This contract will supersede any other contract. If any part of this contract is illegal or unenforceable, the remaining provisions of this contract will remain valid and enforceable to both parties. This contract constitutes the sole and only agreement between the parties hereto and currently sets forth the rights, duties, and obligations of each to the other, as of this date. Any prior statements, agreements, promises, or inducements made by any party hereto, or agent or representative or either party hereto, which are not expressly set forth in this agreement, are of no force and effect and shall not be considered valid or binding. This contract shall not be enlarged, modified, or altered except in writing by both parties and endorsed hereon.

17. Client agrees to defend, indemnify, assume responsibility for and hold DJ harmless from any claims, damages, losses, and expenses by or to any person, regardless of the basis, which pertain directly or indirectly to DJ performance. In the event that a civil action arises in an effort to enforce any provision of this agreement, the losing party shall pay the attorney’s fee and court costs of the prevailing party. Client may not transfer this contract to another party without the prior written consent of the DJ.

18. This agreement is not binding until signed by both Client and DJ, and by signing, each party certifies that they have received a completed copy of it. Any changes must be written and signed by both the Client and the DJ. Oral agreements are non-binding. If any clause in this agreement is found to be illegal, the rest of the agreement shall remain in force.

19. DJ may elect not to exercise their rights as specified in this agreement. By doing so, DJ does not waive their right to exercise those options at a future date.

20. The laws of the Province of Alberta shall govern this agreement. In the event of a lawsuit involving or relating to this agreement, Client agrees that the venue will be in Red Deer Alberta.

21. This agreement shall be excused of detention of the DJ by sickness, accidents, riots, strikes, epidemics, acts of: God, Force Majeure or any other legitimate condition beyond DJ’s control. The Client agrees that under all circumstances, TJ the DJ’s liability shall be exclusively limited to an amount not to exceed the Performance fee. The Client agrees to defend, indemnify, assume liability for, and hold TJ the DJ harmless from any claims, damages, losses and expenses by or to any person, regardless of the basis, which pertains or results directly or indirectly to the company’s performance.

22. The Client agrees to make a final payment for the remaining balance of the contract three weeks (15 business days) prior to the event date by either cash, certified check or money order. Personal checks will not be accepted. DJ will provide written proof of payment upon request.

23. The Client agrees that the Bride & Groom, Company President/CEO, shall have complete control and have the final decision in all facets of the event planning and music selection encompassed by this contract.

24. Any change in date or venue will require a new contract or both client and TJ the DJs signature on original contract authorizing the new date/venue.

25. By signing below, Client warrants that he/she has sufficient funds to pay the Performance Fee and any other charges that may be incurred as detailed in this contract and in the Terms and Conditions provided. The services to be provided by TJ the DJ are specifically for the engagement type specified and none other. If the engagement type is other than specified in this document, TJ the DJ reserves the right to terminate performance.

27. As a courtesy if you would like to add songs or a specific type of music to a DO NOT PLAY LIST these songs will not be played unless specified by the persons listed on this contract. The DO NOT PLAY LIST must be provided at least one week prior to the event by email or letter with at least one signature or name supplied on the list.
